I am so sorry for your situation. Do you mean that you husband does not wish to cooperate in an uncontested divorce and he is contesting it? If he simply does not appear and "defaults" after being served with the divorce pleadings (Summons and Complaint here in New York) and the time prescribed by law to answer has passed, then the court could issue a divorce as to the marriage. Obtaining a division of marital property though is often more difficult. Please seek legal help. Good luck.
