Yes, if someone is a tenant (e.g. pays rent) but is not on a written lease, then he is a month-to-month tenant on an oral lease. The very definition of a month-to-month tenant is that his tenancy may be terminated on a month's notice; that is, he must get a month's notice before he must leave.
