I have been going through a nasty divorce for almost 2 years. We are fighting over custody of our 4 year old daughter. I got pregnant with another man’s baby even though I was on birth control.

Whether or not you are pregnant with another man' child (different than the father of the four [4] year old daughter that you are seeking custody of) should have absolutely no bearing under the laws of all states in this country if you are entitled to custody or not.
Telling in the court's eyes would be if you are a fit and responsible person who would give your four (4) year old the love and attention she deserves.
