Hit and run is charged when the vehicle is occupied. They can be very serious charges. It is considered a crime of "specific intent" meaning that you made the decision to actually leave the scene of an accident. There is an obligation to report any accident - even a car hits a tree and no other car or person is involved needs to be reported. So yes, you need to get a lawyer especially if you may have a defense. And report it to your insurance company as well. Good luck.
