Liable for what? The amount of compensation a person is entitled to is based on the medical costs, if any, lost wages, if any, and--if there was a signiifcant disability or life impairment lasting for months or longer--some amount for "pain and suffering." Without serious injury, there is almost certainly no point in suing--you'd very likely spend more on the lawsuit that you'd get back in compensation.
