If my girlfriend put spyware on my phone, even if she paid for the minutes is this illegal?

I own the phone and we have been living together for about 2 months. She did not tell me before installing the spyware and mentioned after my phone might be tap but did not say by her. When I found out u asked her she admit ed to doing it and took it off right after. Is this illegal and what is the statue of limitations for such a crime?
