If my traffic ticket was never activated due to an error made by the police department, is it legal if they “rewrite the ticket”.
As of today, the ticket still isn’t in the system. Should I fight it?

Under the laws of all states in this country it is permissible for the police department to re-write the apparent lost ticket. The problem for law enforcement is to prove the claim agaunst you when the original ticket has been lost. Based upon what you have written, I suggest that you contest any new citation against you for the traffic offense that you have written about.
