It is perfectly legal, unfortunately. Employment is employment at will in this country and your state: employers freely decide who to hire. They may refuse to hire anyone they want, for any reason not specifically prohibited by law: for example, they can't refuse to hire you due to your race, national origin, sex, age over 40, disability, or religion. However, there is no legal protection against not being hired due to any criminal charges, tickets, or other infractions, no matter how old; they may legally decide to not hire you to due to a 19-year-old dog confinement charge.
