When someone dies without a Will they are said to have died "intestate". This means that the laws of the state in which the deceased was domiciled as of the date of their death control. Typically, the estate in such a situation will first go to any children of the deceased, as their nearest "heirs". This is true whether or not they were estranged from their parent.
