In NC, the "age of consent" is 16 years old. Any sexual intercourse with a person under 16 is prohibited. There is, however, a "close-in-age" exemption if the defendant is less than 3 years older than the victim, which means that they will not be prosecuted. Defendants between 3 and 6 years older then the person are guilty of a reduced charge (class C felony); this is the case in your situation.
