Insurance won’t settle or return calls
hit by another driver now the insurance agent won’t settle, then said check would be here in 14 days never came, now he won’t return my calls.

It isn't clear from your question whether the insurance agent is the one on your policy, or from the driver that hit you. You also haven't said how long ago the accident took place, and there is a time limit on filing lawsuits for automobile accidents.
