Can he receive a US visa? Is there going be a problem for the consul to decide to give him a visa? He has no health risks or criminal record.

No, it should not be an issue for him to receive a family-based visa. As all immigrant visa applicants, he will need to undergo a medical examination with an authorized physician (authorized by the Consulate if abroad or by USCIS if within the US).
