I am a lawyer in CT and practice in this area. It seems usually that this one lady was removed while th emen get to come back to the team. I may rise to discrimination (i.e. sex); however, if the employer has a legitimate nondiscriminatory reason for the removal and this is an isolated incident, then the employer will get away with this. However, if this is not the first time this has happened, then the adverse job action leads to an inference of discrimination.
