I have been working with a toxic co-worker for the last 4 years. Now I’m his boss. I’ve just had enough.

In an "at will" employment relationship an employee can be fired for any reason (even bad one) or for no reason at all, with or without notice. Employers have a great deal of discretion in determining the terms of employment including how and why termination takes place. The only exceptions to this would be if there is an union agreement or employment contract to the contrary, this action would in some way violate existing company policy, or termination is due to some form of actionable discrimination.
