Is the original A/C installer liable for improper installation 9 years later?

I purchased my home about 9 years ago. I have recently found out that a required component wasn’t installed when the heat pump was put in which has caused the compressor to go bad prematurely and voiding the warranty. Is the original installer liable for not properly installing the unit?

Unless the home that you bought was brand new when you purchased it, any claim that you have against the HVAC contractor/installer would be barred by your state' statute of limitations with respect to the faulty installation done nine (9) years ago.
