No matter whose name the deed is in, until there is a final decree of divorce or a legal separation agreement, both spouses have a right to reside in the "marital residence". The exception to this would be if there was an order or protection or the like in place, so that the offending spouse would have to remove themself from the home. However, this would entail that spouse putting the other spouse in fear for their safety.
