First, the property that you Father held jointly with your step Mother would passs automatically to her at the time of his death. Any property that is left and adjudged to be part of his intestate estate would pass via the intestacy statutes. Now, North Carolina distinguishes between real property and personal property for distribution. It is somewhat complicated for this forum. I am going to give you a link. Good luck.
