I am so sorry for your loss. If your Husband dies without a Will then his Probate Estate will pass via intestacy statute in New Jersey. Now, his probate estate includes everything that is not jointly owned with you. If everything you woned was owned as Husband and Wife then it passed to you automatically at the time of his death. So you need not do anything at this time. Should you wish to refinance the house you may need to do a new deed in your name only. Good luck.
