Should my 89 year old mother put her estate in probate, write a Will or set up a Trust?

She does not want to make the mistake she made when my dad died and had to pay large amount of money to collect on his estate.

If your mother wants to avoid the expense of probate, she should set up a revokable living trust.  She should see a wills, trusts and estates attorney to make sure this is set up correctly.
