What to do if my nephew was arrested for domestic violence allegations?

His girlfriend has decided to drop the charges today and bail him out because she is afraid when they see the the judge tomorrow he may get deported. Can they bail him out today or do they need to wait until he sees the judge tomorrow? Does she need to be present when he is in court in front of the judge?

Here is the problem. This obviously stemmed from something and if indeed he committed domestic violence, the prosecutor may be able to move forward with prosecution without her testimony. If he is an illegal resident and the prosecution move for no bail because of a flight issue, he may not be bailed out. If he has seen the judge, please understand that he may be held over for trial.
