Our concern is for our grandchild not so much the mother, sounds harsh but it is the truth of the matter.

Under the laws of all states in this country whether a female is pregant or not does not impact whether a jail sentence will be imposed in that unfortunately many children are born in prison and jail hospitals to incarcerated women. From what you have written, there is a good chance that your son's girlfriend may be jauled if convicted of the offense that you have written about.
