Both  Possession of a small amount of marijauna and Possession of a controlled substance are misdemeanors. Th statute of limitations is atleast 1 year and it may even be 2 years. You have a ways to go before arguing the statute of limitations has lapsed. You may want to look into the ARD Program, which is a County program for first time offenders. The advantage is there is no driver's license suspension and no conviction ( meaning your son would not have a criminal record). Typically, ARD icludes a drug and alcohol evaluation, community service hours, and 1 year of probation.
