How to protect a beneficiary’s rights in an asset of an estate?

My wife’s great aunt passed away this week. She left her money (100k) to my mother-in-law to help take care of her. She and my brother-in-law are both on the account. My wife’s fear is that her brother will go in there and milk the account dry before the Will is read and the funds are disbursed.

The best way to resolve the issue is to have the mother in law place the $100,000 in a separate trust account or give direction in writing to the bank to freeze the account pending the filing of the probate action to save the money from being wasted away.
