When someone dies without a Will, there are said to have died "intestate". This means that the intestacy laws of the state in which they died will contril the distribution of their esttae. Typcially, such an estate is divided 1/2-1/3 to the survivng spouse with the remainder to the children of the deceased. Accordingly, you have a share in your mother's estate but anything inherited by your stepfather goes into his estate. Your attorney can verify this under NH state law and advise you further.
