If so, how do I make sure I get my half?

If there was a will, your parent's estate will pass according to its terms. If there was no will and if your deceased parent was still married to your other parent, that spouse will generally inherit everything. If your parents were divorced, you may be entitled to all or part of the estate, again depending on the intestacy laws of your state.
