my nephew had a vertical brake in his left ankle. It was operated on and set in a cast with screws on the outside. three weeks later his cast was removed to take x-rays. the x-ray machine fell directly on the brake, causing shifting of the bones the dr had set previously. He was then sked for another surgery where they had to re-open the incision and do another complete surgery. does he have a lawsuit?

Although I am not admitted in Kentucky I can guess that yes, he does. It may be difficult to asses what his damages are in this case (what is attributed to the first breakand what is attributed to the second break) but I am sure that there is some pain and suffering and additional time lost for recovery, etc. Personal Injury consultations with attorneys are usually free.
