Anyone can create a non profit organization and probably obtain a foreign corporation registration in each state you plan on doing business (whether you have a brick and mortar site or you have an online presence). You do need to figure out whether the type of business you conduct is considered non profit in the United States and the same in your home country. You may have undue tax implications without knowing it. Consider speaking with a business attorney in the states to ensure you are not only properly setting up the non profit but also considering all tax implications and other business permit matters.
