In many states in this country, the taping of a person's telephone conversation is illegal unless expressly authorized. However, tapings of people talking away from the use of a telephone are allowed in that in such a situation there is no justifiable expection of privacy.
If you are involved in a restraining order situation, I recommend that you consult with an attorney as how to defend yourself and whether or not the tape recording you have written about can be used legally in the proceeding.
