In most jurisdictions a minor cannot choose with which parent they want to live. Although, if they over the age of 12, a judge will give consideration to their preference the older the child the more weight it is given.
In making the determination a minor child will live, the court considers several factors. It will look at the child's relationship with both of their parents, the reason for the child's wanting the change, the income/education of each parent and the like.
Tyically, while a child cannot make this decision, the court will give weight to their preference the older the child the more influence the child's wished are given.
