Once a divorce/separation has been filed but until a final judicial order is issued e.g. a divorce degree is granted, all parties have rights to the "marital home". This is true regardless of whose name the title/lease is in. The execption being if one party has put the other party in fear for isarfety in that case an order can be obtained which will result in the removal of the offending spouse.
