You can file a claim on your own insurance policy assuming that you have collision coverage (your insurer will then "subrogate" the claim and sue the at fault driver). If you do not have such coverge, then your only option is to sue the other driver and hope that they have the money to pay any judgment that you may be awarded agaist them. However, if they didn't have enough money to buy insurance in the first place, then you'll unable to collect any money.
