What to do if here is a forclosed home near our library and it has a swingset that I would like?
It’s has been sitting there for 6 months or so. I called the realitor who said they are just selling the home which the bank owns, so if we want the swingset she will close her eyes to its disapearance. If we did go and pick it up, is that legal and honest?

I would not pick up the swing set on the foreclosed home that you have written about unless you have in writing a note allowing you to take the item signed either by a representative of the property's owner of the real estate agent that is lisitng the property for sale. Picking up the swing set based upon what you have written could cause a lot of problems unless you have written permission to get it.
