If you’re uninsured but are in an accident for which you are not at fault, can you sue the other driver?uninsured car accident

My mother was in a car accident and her insurance which was no fault had expired. She was rear-ended by truck going out of control. Can she go after the person who hit her for damages? If they are insured, will the driver who caused accident be held responsible for payment for damages?

As long as your mother was not at fault, then she can make a claim against the driver who caused the accident. This is true whether or not she was insured at the time.
