What to do if a collections department keeps calling me for a debt that I do not owe?

I have a very common name and they insist I have a credit card charge off. I tell them I am not who they think and they demand the last 4 of my SSN. I tell them the burdon of identity isn’t on me to prove, its on them. They call and harass my wife. I have contacted customer service twice now and they will not remove me from their database. Do I have any recourse, they are falsely accusing me of debt.

I would call and write the collections department to cease all further contact with you in that its continued contact with you could be deemed an unfair debt collection practice under state and federal law. Keep a copy of the letter for future use and need. Do not give the debt collection company any personal information regarding you.

If you keep getting calls from the debt collection company, then you might want to retain an attorney to write a a cease and desist letter for you.
