Under the laws of all states in this country, one can have an open adoption without the need for having an adoption agency involved. In such a situation a person wishing to adopt retains a family law attorney to file the necessary petition with the family law court for the adoption and court order as to such.

The parents of the child being adopted typically have their own attorney representing their interests as well.
