Not following company policy is not legally mandated; failure to comply with it breaks no law. However, if such an action breached the terms of an employment contract or union agreement, then you would have a claim. Also, if your treatment was due to some form of actionable discrimination, that would be illegal. The fact is that most employment is "at will" which means that a company can set the conditions of work much as it sees fit.
