What are the laws on eviction?

I am 2 days late on paying rent and have received a written letter stating that I am evicted. I contacted my landlord 2 weeks prior to rent due date and let him know i would be a week late paying rent and would also pay all late fees in full and pay 2 months in advance. The written letter says I have 24 hours to vacate. Can this be right?

First, some written leases allow a grace period to pay one's rent before the tenant is technically in default on the rental payment. You should carefully read your lease to see if this is true regarding your situation.

In all states there are statutory requirements to end a tenant's lease such as a 30 day notice of termination sent by the landlord or a 3 day notice to pay or quit. Neither has happened in your situation.

The 24 hour letter stating that you have to vacate is in violation of state law and has no force and effect. I suggest that you consult with a landlord tenant over your situation.
