What are the possibilities for sentencing during a DUI case for someone that has a perfect driving record and no prior criminal charges?

He was camping and had a few drinks and went to the store to get a cake for his son’s birthday. He has a perfect driving record and no prior criminal charges. However, his son was in the car with him. What are his possibilities for sentencing and does he have a chance at getting away without jail time?
