In every lease, there is a covenant of quiet enjoyment, which means that the tenant cannot be disturbed in his or her use and enjoyment of the premises.
Your noisy neighbor constitutes a breach of the covenant of quiet enjoyment. There are various remedies for a breach of the covenant of quiet enjoyment. You can sue the landlord for breach of the covenant of quiet enjoyment or you can withhold rent or you can move out. If you move out and a court subsequently determines that there wasn't a breach of the covenant of quiet enjoyment, you will remain liable for the rent.
