What can I do, I have an employee that isn’t working 40 hours per employment agreement and is salary?

If you have a written agreement and the employee is not living up to it then they are in breach and you can sue them based upon same or do what ever the agreement states. If the agreement is oral and not written then they are an employee at will and you are not obligated to keep them on but I would give them a warning both orally (in a private meeting) and written.
