In order to get sole legal and/or physical custody of your minor child where you and the other parent were never married you can either have the other parent sign a stipulation to that effect with a court order and have such filed with the court. If that is not an option, then you need to file a petition with the court seeking the relief that you desire.

If a petition needs to be filed, I suggest that you consult with a family law attorney to assist you in that endeavor.
