When are fees taken out ofan injurysettlement?

My case was settled and the lawyer took his 40% cut. My problem is he took it before any of the medical bills were paid. $16500 is settlement; his 40% is $6600; medical bills $3179′ my cut $6623. I feel it should be divided after all medical bills are paid, is there anything I can do to fix this?

What occurred here is the normal procedure for order of payment in a settlement.  The attorney's fee is paid first.  Then, liens (medical bills) are paid.  The remaining balance is paid to the client.

Considering your total medical bills, the settlement of $16500 is quite reasonable.

Since the case has been settled, nothing further can be done to change the outcome.
