Where do we file for divorce?

We were married in Utah a year and a half ago. We moved to California about a year ago and have lived here since. My wife recently left and went back to Utah. Can I file here in California and/or can she file in Utah?

To file for divorce in California, either you or your spouse must have lived in:

  • California for the last 6 months, AND
  • The county where you plan to file the divorce for the last 3 months.

To file for divorce in Utah, either you or your spouse must have lived in:

  • Utah for at least 3 months, AND
  • The county where you plan to file the divorce for at least 3 months.
