You can't do anything-or rather, you're not entitled to any monetary compensation for their failure to provide the W-2. You could bring a lawsuit seeking a court order that they provide it, but you'd have to pay for the lawsuit entirely out of pocket without any offsetting compensation. Sometimes workers just don't get W-2s for any of a number of reasons: lost in mail, company fails to generate them, company goes out of business, etc. You may have to file your taxes without them and send in a cover letter to the IRS stating that you have not received one and the efforts you've made.
