The taxi driver would be liable for negligence. Negligence is the failure to exercise due care (that degree of care that a reasonable taxi driver would have exercised under the same or similar circumstances to prevent foreseeable harm).
The taxi driver's liability would include the child's medical bills and pain and suffering which is an amount in addition to the medical bills based on the medical reports.
